  • California: A wrongful death claim generally must be brought against the responsible public entity within 6 months of accrual. A compliant written rejection generally starts a six-month lawsuit period from mailing or personal delivery.
  • Texas: A government notice is generally required within 6 months of the incident, but valid city rules may impose an earlier deadline. Do not assume the notice period starts on the date of death.

Responsibility may extend beyond the driver. Depending on the evidence, potentially liable parties include:
